Proposed PKSB Licensing Framework


Proposed Terms and Conditions for the CILIP website

CILIP maintains and develops a suite of content, products and services known collectively as ‘the PKSB’ or the ‘Professional Knowledge and Skills Base’ (known hereafter as the ‘licensed material’) on behalf of people working in knowledge, information, data and libraries as part of the delivery of our charitable objects as set out in our Royal Charter.

In accessing and using the licensed material, the user affirms that they are aware of and will comply with the terms of the provisions contained in these Terms and Conditions.


Definitions

For the purposes of these Terms and Conditions, the following definitions are understood:

Licensor The Licensor of the licensed material is the legal entity currently registered as the Chartered Institute of Library and Information Professionals (CILIP).
Licensee The individual or legal entity that is in receipt of the grant of rights and restrictions defined under these Terms and Conditions.
Licensed material The licensed material governed by these Terms and Conditions includes the content, products and services described below.
‘Core’ standard The current version of the PKSB Standard, published in an electronic format
Trademark and brand Materials which represent the PKSB trademark and brand including graphics, logos, typography, layout, structure and design elements.
Interactive PKSB The software, content, interactive and design elements which allow a user to interact with and make use of the PKSB via a web browser.
Purpose-specific PDF Derivative works, versions, excerpts and other arrangements of the content of the ‘core standard’ produced for specific purposes or needs.
Guidance materials Supporting content and documentation produced for the purposes of instructing people in the use of the PKSB.
Marketing materials Content, graphical elements and other materials (print and digital) produced for the purposes of promoting and engaging people with the content and purpose of the PKSB.

Intellectual property and copyright

CILIP asserts ownership of the intellectual property in the licensed material including but not limited to the content, products and services collectively identified as ‘the PKSB’ or ‘Professional Knowledge and Skills Base’ (or such future branding or identities as are applied to the same).


Trademark

CILIP asserts our right of trademark in ‘the PKSB’, the ‘Professional Knowledge and Skills Base’ and all variants thereof in all languages and jurisdictions in perpetuity.


Disclaimer

CILIP publishers the licensed material for the purposes of instruction and skills development for people working in knowledge, information and libraries. The information is provided as-is and without warranty.

CILIP disclaims all liability for any loss or damage arising from the use of the licensed material including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of the licensed material.


Terms of Use – interactive PKSB

CILIP provides access to an interactive version of the PKSB subject to these Terms of Use, which may be updated by us from time to time. By accessing and using the interactive PKSB, you accept and agree to be bound by these terms.

We will make reasonable efforts to ensure continuity of access to the interactive PKSB. We may change or discontinue any aspect, service or feature of the interactive PKSB at any time, including, but not limited to, content, availability, and equipment needed for access or use.


Data Protection and Privacy – interactive PKSB

CILIP take data protection and privacy seriously. You data will be securely stored within our PKSB database that is hosted by FAT Promotions. Your data will be used and processed to enable you to use the interactive PKSB – e.g. to enter your scores and monitor your progress across the different skills and knowledge areas. We will also use your data to monitor engagement with the PKSB and to suggest relevant products and services that will help you enhance your knowledge and skills. Individual Use Licence

The licensed material is licensed for individual personal use under the following terms:

  • Access to the licensed material is restricted to current members of CILIP.

  • CILIP members are permitted to access, download and use the core standard and guidelines in electronic format;

  • CILIP members are permitted to cache, save or otherwise store locally (including via a Local Area Network) the electronic copies of these materials;

  • CILIP members are permitted to excerpt or make extracts of the core standard, purpose-specific PDF and guidelines for the purposes of their own instruction and professional development;

  • CILIP members are permitted to share these excerpts or extracts internally to their organisation for the purposes of communication with a line manager, for example as part of an appraisal;

  • CILIP members are permitted to access, download and store branded and trademarked material but may not make use of this material for the purposes of ‘passing off’ of making representation on behalf of CILIP without express prior written authorisation.

Users are not permitted to do any of the following without the express written permission of CILIP:

  • Create derivative works based on the Professional Knowledge and Skills Base;

  • Re-license or share any of the content commercially, including for the avoidance of doubt as part of the delivery of a course of instruction or training.

CILIP retains the right to withdraw this licence in the event that an individual ceases to be a CILIP member or where a member is found to be in material breach of these conditions.

CILIP retains in all circumstances the right to amend, edit, remove or otherwise change the content of the licensed material at any time.

Where these rights are withdrawn, the individual is required to provide confirmation that all licensed material has been deleted from their systems.


Employer Partner Licence

The CILIP Employer Partner Scheme is an organisational membership scheme operated at the sole discretion of CILIP.

The licensed material is licensed for use by legal entities that are current members of the Employer Partner Scheme under the following terms:

  • Access to the licensed material is restricted to legal entities that are current members of the Employer Partner Scheme in good standing;

  • Representatives of Employer Partner organisations are permitted to access, download and use the core standard and guidelines in electronic format;

  • Representatives of Employer Partner organisations are permitted to cache, save or otherwise store and distribute locally (including via a Local Area Network) the electronic copies of these materials;

  • Representatives of Employer Partner organisations are permitted to excerpt or make extracts of the core standard, purpose-specific PDF and guidelines for the purposes of instruction and professional development, including for the avoidance of doubt for use in the development of internal training and CPD materials;

  • Representatives of Employer Partner organisations are permitted to use the structure and content of the PKSB, purpose-specific PDF and guidelines under the terms of this license to undertake internal workforce development including skills mappings and training needs analyses;

  • Representatives of Employer Partner organisations are permitted to share excerpts or extracts from the licensed material internally to their organisation for the purposes of staff development, for example as part of appraisals;

  • Representatives of Employer Partner organisations are permitted to access, download and store branded and trademarked material but may not make use of this material for the purposes of ‘passing off’ of making representation on behalf of CILIP without express prior written authorisation.

The above permissions represent a limited grant of rights for the creation of derivative works of the PKSB, purpose-specific PDF and guidelines. In exercising these rights, Employer Partner organisations confirm that they will not create materials and resources based on all or part of the licensed material which in effect compete with or otherwise undermine the integrity of the standard.

Users are not permitted to do any of the following without the express written permission of CILIP:

  • Re-license or share any of the content commercially, including for the avoidance of doubt as part of the delivery of a course of instruction or training.

CILIP retains the right to withdraw this license in the event that an organisation ceases to be an Employer Partner Scheme member or where a member organisation is found to be in material breach of these conditions.

CILIP retains in all circumstances the right to amend, edit, remove or otherwise change the content of the licensed material at any time.

Where these rights are withdrawn, the member organisation is required to provide confirmation that all licensed material has been deleted from their systems.


Learning Partner Licence

The CILIP Learning Partner Scheme is an organisational membership scheme operated at the sole discretion of CILIP, available to providers of teaching, learning or instruction in Library and Information Science or a related professional or technical discipline who have achieved CILIP Accreditation.

CILIP recognises the embedding of the PKSB into teaching and learning as an important element of the fulfilment of our charitable purpose as defined under our Royal Charter. We further recognise that Learning Partners require more permissive rights to embed the licensed material into curricula.

The licensed material is licensed for use by legal entities that are current members of the Learning Partner Scheme under the following terms:

  • Access to the licensed material is restricted to legal entities that are current members of the Learning Partner Scheme in good standing;

  • Representatives of Learning Partner organisations are permitted to access, download and use the core standard and guidelines in electronic format;

  • Representatives of Learning Partner organisations are permitted to cache, save or otherwise store and distribute locally (including via a Local Area Network) the electronic copies of these materials;

  • Representatives of Learning Partner organisations are permitted to download and share the core standard with their students for the purposes of contextualising and aligning the taught curricula to the sector standard.

  • Representatives of Learning Partner organisations are permitted to excerpt or make extracts of the core standard, purpose-specific PDF and guidelines for the purposes of instruction and professional development, including for the avoidance of doubt for use in the development and distribution of course materials and inclusion in VLE platforms;

  • Representatives of Learning Partner organisations are permitted to use the structure and content of the PKSB, purpose-specific PDF and guidelines under the terms of this license to support the development of modules or courses of instruction, curricula and course content, including to facilitate the process of Accreditation;

  • Representatives of Learning Partner organisations are permitted to share excerpts or extracts from the licensed material internally to their organisation for the purposes of staff development, for example as part of appraisals or curricula development in other departments, schools or faculties;

  • Representatives of Learning Partner organisations are permitted to access, download and store branded and trademarked material but may not make use of this material for the purposes of ‘passing off’ of making representation on behalf of CILIP without express prior written authorisation.

The above permissions represent a limited grant of rights for the creation of derivative works of the PKSB, purpose-specific PDF and guidelines. In exercising these rights, Learning Partner organisations confirm that they will not create materials and resources based on all or part of the licensed material which in effect compete with or otherwise undermine the integrity of the standard.

Users are not permitted to do any of the following without the express written permission of CILIP:

  • Re-license or share any of the content commercially, except on a limited basis as part of the delivery of a course of instruction.

CILIP retains the right to withdraw this license in the event that an organisation ceases to be an Learning Partner Scheme member or where a member organisation is found to be in material breach of these conditions.

CILIP retains in all circumstances the right to amend, edit, remove or otherwise change the content of the licensed material at any time.

Where these rights are withdrawn, the member organisation is required to provide confirmation that all licensed material has been deleted from their systems.


Other licensees not included above

CILIP retains the right to provide access to all or part of the licensed material as part of partnership agreements with 3rd parties.

Terms and conditions of access to the licensed material, including the use of the ‘interactive PKSB’ will be governed under a distinct Licence, to be agreed with the Licensee.
